Justice Farouq Lawan of the Kano State High Court today, March 28, 2014, convicted and sentenced one Moses Kola Olayemi to three years imprisonment and  a fine of N120, 000 (One Hundred and Twenty Thousand Naira Only) on three count charge of conspiracy and criminal breach of trust.
The convict is said to have conspired with one Ahmed Rufai to deceive one Dr. Sa’id Danladi Abubakar into believing that they were online car sellers.
The accused person had earlier pleaded not guilty to a five count charge. But when the case came up today, he pleaded guilty to an amended three count charge.
Based on his plea, counsel to EFCC, M.M Gambo urged the court to convict the accused accordingly.
However, the defense counsel, A.A Sani, pleaded with the court to tamper justice with mercy in sentencing the convict as he was a family man with aged parents and many dependants.
Justice Lawan consequently convicted the accused on all the three counts under Sections 93 and 311 of the Penal Code. The sentences are to run concurrently.
One of the count reads “that you Moses Kola Olayemi and Ahmed Rufai at large sometimes in 2010 at Kano within the jurisdiction of this honorable court entrusted with the sum of N2, 000, 000 (Two Million Naira Only) by Dr Abubakar Sa’id for the purpose of selling to him two cars dishonestly misappropriated same and you thereby committed an offence under section 311 and punishable under section 312 of the Penal Code.”

  1. I don't understand Nigerias legal system! How can a man defraud someone of 2million and be asked to pay 120thousand? What of the anguish the buyer suffered? Where are the punitive fines apart from paying the initial amount? What of the legal costs to the poor buyer for seeking justice? I really don't understand...
