Former Managing Director, defunct Gulf Bank Plc, Johnson Adeyeba, was yesterday re-arraigned before a Federal High Court in Lagos by the police for alleged N12 billion fraud.
Adeyeba was re-arraigned alongside seven others, including a Briton, Gareth Wilcox, charged with his companies-Ibom Power Company and LYK Engineering Company, as well as a lawyer, Uche Uwechia.
Other accused are Ignatius Ukpaka and John Ezugwu who are also charged with their company, Taurus Shelters Ltd.
The accused were re-arraigned on an amended 21-count charge bordering on fraud and financial malpractices.
They all pleaded not guilty to the charge.
The first to fifth accused had on December 23, 2013 been arraigned before the court to which they pleaded not guilty.
They were alleged to have converted over N12 billion from the defunct bank in the guise of granting loans and overdraft facilities to various companies without appropriate accounting records.
The accused were alleged to have converted and appropriated a total of $55.3million and over N3.7billion belonging to the bank.
Part of the money was said to have been used to finance a non-existing refinery, while the others where converted to personal use.
The alleged offence was said to have contravened Section 390 of the Criminal Code, Laws of the Federation, 2006.
Justice Mohammed Yunusa had granted them bail in the sum of N200 million each, with two sureties each in like sum.
When the case was called on yesterday, prosecuting counsel, Dania Abdullahi, informed the court of a consolidated charge, including the names of two more accused and their company, Ukpaka, Ezugwu and Taurus Shelters Limited.
Abdullahi prayed the court for the accused to be re-arraigned on the amended charge.
After their re-arraignment, counsel for the fifth accused, Revell Ogunde (SAN), prayed the court to allow the accused continue on the bail earlier granted by the court.
Lawyer representing the sixth to eight accused, Linus Omeye, also prayed the court to allow his clients enjoy the conditions of bail granted to the other accused who had previously been arraigned.
Justice Yunusa granted the prayers of defence counsel.
Meanwhile, Ogunde informed the court that he had filed a motion challenging the jurisdiction of the court to hear the suit.
He argued that the police had no constitutional right to prosecute financial crimes without the authority of the Economic and Financial Crimes Commission (EFCC).
Ogunde stressed that the offence against the accused is a general offence which was embedded on the residual list, and so, can only be entertained by the state High Court.
He, therefore, urged the court to strike out the charge against his client.

His submission was supported by the lawyer to the sixth to eight accused; hence the court adjourned the matter to April 14 for ruling.

According to a source, the new grandma in town, Salawa Abeni, had gone for shopping at Shoprite when an overzealous security man engaged her in an argument.
It was stated that the ugly incident began when one of the guards asked Salawa to offload all the items inside the cart she was pushing towards the main entrance of the mall.
She reportedly questioned the reason for such, but the security man insisted that it was the policy of the mall not to allow the carts to be taken out by customers.
However, the argument between the two lasted for minutes as all explanations by the musician to make the guard see reasons with her fell on deaf ears.

Eventually, Salawa was forced to pick her items to her car in bits. Her son and one other dude helped the singer in accomplishing the task.

A Connecticut pastor seeking to cleanse his soul for a long-past infidelity met fire and brimstone, then forgiveness from his flock before reportedly keeling over from a suspected heart attack.
Bishop Bobby Davis, pastor and founder of the Miracle Faith World Outreach Church in Bridgeport, kept parishioners after services Sunday, saying he wanted to come clean about an apparent affair he’d had, one congregant told the Connecticut Post. Although police are investigating the incident, indications are that he suffered a fatal heart attack after getting a mixed response.
“After the service on Sunday, the bishop’s family asked us to remain in the church and the bishop confessed to us something that happened long ago,” parishioner Judy Stovall told the newspaper. “He wanted to come clean with all of us. He wanted to ask our forgiveness.”
Davis, who served as pastor since the church was founded in 1967, reportedly dropped to the floor during the screaming.
“We were shouting, `We forgive you, we love you,’ but the stress of all of it — he had a heart attack,” Stovall told the paper.
“I held his head as he lay on the floor … Our congregation is hurting now.”
Davis, of Monroe, founded the church with his wife, Christine. The couple celebrated their 50th wedding anniversary last June, the newspaper reported.

Davis was pronounced dead at Bridgeport Hospital. The cause of death is still under investigation, according to police sources who spoke to the newspaper.

Covenant University, Ota in Ogun State reinforced its ban on the use of mobile devices by students of the school when on Thursday, March 13, 2014 a special notice was sent out with the institutions list of prohibited items.
In a notice signed by the Dean of Student Affairs, Mr. Azubuike, the students are prohibited from using or being in possession of phones, phone chargers, sim cards, and tablets.
Any student caught violating these rules will be sanctioned with four weeks suspension.
Covenant University, which was awarded Nigeria’s Best Performing Higher Institution in 2013 by the Centre for Democratic Governance in Africa (CDGA), has a very strict policy on disciple and learning.

A father in Houston fatally shot a teenage boy whom he caught in bed with his equally teenage daughter in her bedroom on Thursday, March 13, March.
The father was tipped by one of his children that there was someone in his 16-year-old daughter’s bedroom, he got to the room and shot the 17-year-old boy.

FOX News reports:
A Houston-area father fatally shot a 17-year-old boy who was inside his teen daughter’s bedroom early Thursday morning.
The confrontation occurred around 2:20 a.m. The father had a gun and asked the teen to identify himself, police said, according to the report. His daughter reportedly told her father that she did not know the teen and that the two were not in bed.
The father said he told the teen not to move, but reportedly saw the teen reach for something, at which point police say the father opened fire. The teen did not have a gun. His daughter later confessed that she did indeed know the teen, the report said.
“You just feel terrible for the families,” one neighbor told the station. “You just kind of reflect on both of these families’ lives have changed forever.”

The father was taken by ambulance from the home for treatment of an unrelated medical situation. So far no arrests have been made, but detectives told the station that they are going to refer the case to a grand jury

A Jewish man has been served a two-year jail sentence by an Israeli magistrate court for smuggling uninspected eggs from the Palestinian territories into Israel, for many years. He was charged with 34 counts.
According to Jewish News, Eliyahu Abraham was specifically charged with transport and possession of illegal eggs and forging “sell by” dates. Abraham sold eggs raised by unlicensed breeders and without any veterinary supervision.

Abraham also transported the eggs without proper refrigeration and without the necessary permits. In 2013, Abraham was caught by investigators of the Ministry of Agriculture.

Be’er Sheva Police also seized 290,000 in illegal eggs. The Magistrate’s Court of Be’er Sheva was told that Abraham risked the public’s health by potentially spreading dangerous diseases.

The court also ordered Abraham to pay a 65,000 shekel ($18,500) fine.

Lagos, Feb. 28, 2014 (NAN) A Federal High Court in Lagos on Friday fixed March 21 to hear a motion filed by the suspended  Governor of Central Bank of Nigeria (CBN), Malam Sanusi Lamido Sanusi, seeking enforcement of his fundamental right.

Lamido had filed the suit through his counsel, Prof. Yemi Osibanjo (SAN), seeking an order restraining the police and officers of the State Security Service (SSS) from arresting, detaining or otherwise harassing him.
Joined as first to third respondents in the suit are: The Attorney General of the Federation (AGF), Inspector General of Police (I-G) and the SSS.
When the case was mentioned on Friday, Justice Ibrahim Buba adjourned it to March 21 for hearing, following an application for adjournment moved by counsel to all the respondents.
Counsel to the AGF, Dr Oscar Nliam, holding the brief of Chief Mike Ozekhome (SAN), informed the court that his office had just been briefed on the matter.
He told the court that they were yet to receive all the processes filed by the applicant, and therefore prayed the court for a short adjournment to enable him collate all processes.
Counsel representing the I-G, Mr Chukwu Agwu, on his part, informed the court that he was only notified last night by his boss from the Force Headquarters that the suit will be coming up in court.
He said that the second respondent was yet to receive the processes and also prayed the court for an adjournment to enable him look at the processes when they arrive.
In the same vein, counsel representing the SSS, Mr Ahmed Musa, also aligned himself with the submissions of his colleagues, adding that an adjournment will be to their favour especially as parties were still within time of filing.
Counsel representing the applicant, Mr Kola Awodehin (SAN),, did not object to the prayers for adjournment, but noted that the suit bordered on fundamental rights enforcement and ought to be dealt with expeditiously.
Justice Buba, however, in a short ruling, adjourned the case to March 21 for hearing.

The News Agency of Nigeria (NAN) recalls that the court had on Feb. 21, granted an interim order of injunction, restraining the respondents from arresting, detaining or harassing the applicant, pending the determination of the motion on notice.
The interim order was sequel to an affidavit of urgency filed by the applicant on the same date.

The court had also granted the applicant leave to serve the originating summons and other accompanying court processes on the respondents.

Nigeria’s National Emergency Management Agency (NEMA), on Wednesday confirmed that 13 dead bodies have been recovered from the boat accident in Festac Town, Lagos on Tuesday.
Mr. Ibrahim Farinloye, Information Officer, said the boat capsized at 4th Ave, opposite 41 Road Junction in FESTAC Town, Lagos.
He said the accident occurred while the boat was trying to cross the passengers from one side of the road to the other over a distance of about 10 metres.
Farinloye said the boat had over 15 passengers and confirmed that among the dead were six children, while five persons were still missing.
The NEMA official said that there were six survivors.
He added that a distress call came to the agency at 11.10 p.m. on Tuesday and said that rescue operation led to the recovery of the bodies.
Farinloye said that NEMA in collaboration with other emergency service agencies was continuing with the rescue operation.
Also Dr. Femi Oke-Osanyintolu, General Manager, Lagos State Emergency Management Agency (LASEMA), confirmed that 13 dead bodies had been recovered from the mishap.
Oke-Osanyintolu told NAN on Wednesday that the surviving victims had been taken to hospital for treatment.

“Thirteen persons have been confirmed dead and their bodies recovered, while six of the victims have been taken to the Lagos State University Teaching Hospital (LASUTH) for treatment,’’ he said.

Residents of Ofulonu in Nsukka, Enugu State have been gripped with shock following the mysterious death of an 8-year-old girl identified as Chiemerie Asadu.
We gathered that the girl reportedly committed suicide Monday afternoon.
Sympathizers who trooped to the scene in their numbers stood speechless as nobody could adduce reason behind the alleged suicide, considering the age of the deceased.
A resident, who expressed utter shock over the incident, told us that she saw the girl full of life in the morning.
“I am terribly surprised because I saw that girl playing with other children when I was going to the market in the morning.
“I wonder what will make a girl of eight to commit suicide. Another thing that surprises me is that the two legs of the victim are on the ground, which is not normal when one commits suicide; the legs should be hanging up.
“I urge the police and relevant security agencies to investigate that suicide; even the rope on the neck of the victim is not strong enough to kill her.
“If you look at that rope, you will understand what I am saying. So, I think there is a cover-up here; the police investigation will unravel the real circumstance behind the death”, she said.

Meanwhile, Mr. David Ajibo said the victim, daughter of his brother in-law, was living with him.
According to him, “This girl has been staying with us since her father died. I am shocked; I don’t know what to say; only God knows what happened.
“She was hale and hearty when I left the house in the morning and I wonder what will make a small girl of eight to commit suicide”.
When contracted, the spokesman of the Enugu State Police Command, Ebere Amaraizu, who confirmed the incident “the police have commenced investigations into the sudden and unnatural death that occurred on 10/03/14 at about 3.20pm at Ofulonu Nsukka, where a little girl of about eight years hanged herself dead in the bathroom.

“Corpse of the deceased is now deposited at Bishop Shanahan Mortuary at Nsukka just as investigations are intensified to unravel the circumstances surrounding the incident”.

The Sabo Police Station on Tuesday arraigned a 49-year-old pastor, Moyo Martins, before a Yaba Chief Magistrate’s Court for allegedly cutting off the fingers of a two-year-old child, Saidat Faleye.
The incident happened on Olumo Street, Iwaya Onike, Yaba, Lagos State.
It was learnt that the mother of the victim, Mrs. Bola Faleye, had left her in the care of Martins on Thursday, when she wanted to take her bath.
After she was gone, the child and the suspect were said to have been together in his room.
About five minutes later, the child suddenly let out a loud shriek of pain which drew the attention of neighbours.
They reportedly alerted her mother who equally rushed to the scene in panic. She found her child’s ring and little fingers chopped off.
It was alleged that Martins sawed off the fingers in his room.
The kid was said to have been rushed to a hospital within the area for treatment.
The suspect initially denied knowing anything about the incident. However, upon his arrest, he allegedly confessed that he did it in error and pleaded to be forgiven.
He was arraigned on one count, which reads, “That you, Moyo Martins, on March 6, 2014, about 1.10pm, at 5, Olumo Street, Iwaya Onike, Yaba, Lagos in the Yaba Magisterial District, did use sharp saw to cut off the left finger of one Saidat Faleye, aged 2 years.”
The police prosecutor, Mr. F. Ifijeh, said the offence was punishable under Section 243 of the Criminal Law of Lagos State, Nigeria, 2011.
The defendant pleaded not guilty to the charge and elected summary trial at the magistrate’s court.
The Chief Magistrate, Mrs. Y.O Aje-Afunwa, admitted him to bail in the sum of N100,000 with one surety in like sum.
The matter was adjourned till April 24, 2014.

The son of the monarch of Ojokoro, Lagos State, western Nigeria, Ade Taiwo, has been arrested by the police for alleged armed robbery.
Police sources said Ade and four other suspects were arrested for alleged armed robbery in the area following a tip-off.
Ade was arrested on Tuesday by the police at Ojokoro division and transferred to the State Anti-Robbery Squad, SARS, Ikeja, Lagos.
Source revealed that Ade’s arrest followed a robbery attack in Ojokoro recently and some suspects who were arrested allegedly implicated him.
However the incident was confirmed by a policeman at Ojokoro division who did not want his name mentioned.
“Yes the police arrested some suspected armed robbers including the son of the Kabiyesi (monarch) and we have transferred the matter to SARS.”

The Economic and Financial Crimes Commission on Monday March 10, 2014 arraigned the quartet of Joseph Sule Emoabino, David Eson Igbinoba, Agbator Gaskin Efe and Dr. Simon Imuekeme before Justice Esther Edigin of the Edo State High Court on an 8-count charge that borders on diversion of  the sum of N113 million allocated for a particular project to another project contrary to section 22(5) of the Corrupt Practices and Other Related Offences Act 2000 and engaging in criminal conspiracy to commit an offence contrary to section (26) (1) (c) of the same Act.”
The quartet  who were chairman, secretary, director of Finance and Accounts of the State Universal Basic Education Board and Secretary to Edo State Government respectively are alleged to have fraudulently diverted the said sum to a project not covered by the intervention funds allocated by the State Universal Basic Education Commission.
One of the charges reads, “that you Joseph Sule Emoabino, David Eson Igbinoba, Aghator Gaskin Efe and Dr. Simon Imuekeme being chairman, secretary, director of finance and accounts of State Universal Basic Education Board, Edo State and secretary to government of Edo State respectively, on or about the 5th of June, 2012 in Benin within the jurisdiction of Edo State High Court, spent the sum of N16,853,242.58 (Sixteen Million, Eight Hundred and Fifty Three Thousand, Two Hundred and Forty Two Naira, Fifty Eight Kobo) for construction of perimeter wall fence in Ivbiore Primary School Ugbor, a project not covered by the intervention funds allocated by the State Universal Basic Education Commission/state government and thereby committed an offence.”
When the charges were read to the accused persons, they all pleaded not guilty.

In view of the plea of the accused persons, counsel to EFCC, Aso Larry Peters asked the court to fix a date for trial. However, counsel to the 1st and 4th accused persons, H. I. O Oshomah and O. A. Omonuwa (SAN) told the court that they had filed applications for bail for their clients.

For few years now, there has been a major problem about 419ers whom calls themselves, developers or care-taker, collecting money from lots of people over a few numbers of rooms in a particular house. Such cases is no longer news in Nigeria, Lagos in particular.
However, few years back, such case happened in 15, Shokunbi Street, in Mushin. One Bayo Lawal (A.k.a Bayo Wale Investment), a developer who build a two storey building with about 19flats and 7 shops and collected money from about 128 people.
However, after endless efforts from the defrauded tenants, Bayo was arrested and his case transfer to EFCC’s office. Few years after, judgment was giving as Bayo was sentenced to 5years imprisonment and restoration of N62,573,000.00 instead of the N100,000,000.00;


























In conclusion, we are appealing to President Ebelle Goodluck Jonathan (GCFR) to come to our aid has EFCC as turn in lackadaisical attitudes towards this case.

A Nigerian lady has thrown a British asylum judge into trouble after police arrested her in the judge’s home, not just for criminal damage, but also for living in Britain illegally.
The Nigerian, Fatima Umar, 39, lived with Senior Tribunal Judge Richard McKee, 65, in his home. The police arrested her following the report of a break-in the Kilburn basement flat of the North London home of the judge.
According to a report in Mail Online, Fatima apparently resisted arrest and was said to have assaulted the two constables who wanted to arrest her.
Fatima was charged with causing around £5,000 of criminal damage at the Kilburn property and assaulting two police officers. She is now serving two eight-week prison sentence and faces deportation.
For Mckee, his problem with the law was that he was found to have been helping the Nigerian partner financially.
He was also found to have been very soft on asylum cases that came before him for determination.
